SMSNiti provides bulk SMS, WhatsApp messaging, RCS messaging, voice call (IVR), email marketing, and related marketing and advertising services (collectively, the "Services") to business clients. This Privacy Policy explains what information we collect, how we use and protect it, and the rights available to you. It applies to visitors of www.smsniti.com (the "Site"), our business clients, and the end recipients who receive messages sent through our platform on behalf of our clients.

By using the Site or the Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Site or the Services.

1. Who This Policy Covers

This Policy applies to three categories of individuals:

  • Site visitors — anyone browsing www.smsniti.com or submitting an enquiry, quote, or contact form.
  • Clients — businesses and their authorized users who register for and use SMSNiti's messaging and marketing Services.
  • End recipients — individuals who receive SMS, WhatsApp, RCS, voice, or email messages sent by our clients using SMSNiti's platform.

2. Information We Collect

2.1 Information you provide to us

  • Contact details submitted through enquiry, "Get a Quote," or contact forms (name, email address, phone number, company name, and message content).
  • Account and billing information provided by clients when they register for the Services (business name, GST/tax details, billing address, and payment references).
  • Recipient contact lists and message content that clients upload or configure through our platform to run their SMS, WhatsApp, RCS, voice, or email campaigns.

2.2 Information collected automatically

  • Standard web log data (IP address, browser type, device type, pages visited, referring URL, and timestamps).
  • Approximate location derived from IP address, used only to localize country-code selection on our forms.
  • Cookies and similar technologies used for site functionality, analytics, and remembering form preferences. You can control cookies through your browser settings.

2.3 Information generated through use of the Services

  • Message delivery data — delivery status, read receipts (where the channel supports them), timestamps, and error/bounce codes for SMS, WhatsApp, RCS, voice, and email sends.
  • Opt-in and opt-out records for WhatsApp, RCS, and SMS communications, which we and our clients are required to maintain under applicable messaging and telecom regulations.
  • Call logs and IVR interaction data for voice-based Services.

3. How We Use Your Information

  • To provide, operate, and maintain the Services, including routing and delivering messages on behalf of our clients.
  • To respond to enquiries submitted through our Site and to provide quotes and customer support.
  • To manage client accounts, billing, and service usage.
  • To maintain consent, opt-in, and opt-out records as required for WhatsApp Business Platform, RCS Business Messaging, and Indian telecom (TRAI/DLT) regulations.

We do not sell personal information to third parties. We do not use recipient contact lists uploaded by our clients for any purpose other than delivering that client's messaging campaigns, unless required by law.

4. WhatsApp, RCS, and SMS Messaging — Consent and Opt-Out

Messages sent through SMSNiti's WhatsApp, RCS, and SMS Services are sent by our clients to recipients who have provided consent to that client (opt-in), in accordance with the messaging policies of the underlying channel providers and applicable law. SMSNiti requires its clients to obtain and retain valid recipient consent before sending any commercial message, and to honor opt-out requests promptly.

End recipients can stop receiving messages at any time by using the opt-out method provided in the message (for example, replying "STOP" for SMS/WhatsApp, or using the in-conversation stop/block option on WhatsApp and RCS), or by contacting the business that sent the message directly. Recipients may also contact us at the address below and we will forward the request to the relevant client and maintain a suppression record where technically possible.

5. How We Share Information

We may share information with:

  • Licensed channel providers — the SMS, WhatsApp, RCS, voice, and email infrastructure and gateway partners we use to deliver messages, solely to the extent necessary to route and deliver client campaigns.
  • Secure cloud infrastructure and hosting providers that store and process data on our behalf under contractual confidentiality and security obligations.
  • Trusted payment processors, for billing purposes only.
  • Regulators and authorities, where required by applicable law, court order, or governmental request.
  • Successors, in the event of a merger, acquisition, or sale of business assets, subject to this Policy continuing to apply to the transferred data.

6. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal and regulatory obligations (including consent/opt-out records required under telecom and messaging-channel rules), resolve disputes, and enforce our agreements. Campaign and recipient data uploaded by clients is retained for the duration of the client relationship and a reasonable period thereafter, after which it is deleted or anonymized unless a longer retention period is required by law.

We use administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, alteration, disclosure, or destruction, including encrypted transmission (HTTPS/TLS) and restricted access to production systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
